Carnival Australia – Image Library Terms of Use
All images, photographs, pictures, designs and illustrations (collectively "Materials") appearing on this website are protected by worldwide copyright laws and other applicable laws and regulations. Carnival plc trading as Carnival Australia is either the owner of the Materials, including all copyrights and other ownership and intellectual property rights therein, or has been granted the right to use the Materials by their owner(s). The Materials may not be used, copied, reproduced, modified, distributed, posted or transmitted in any manner, other than as specifically provided for in these Terms of Use without the express prior written permission of Carnival Australia on behalf of cruise line brands Carnival Cruise Lines, Cunard Line, Holland America Line, P&O Cruises Australia, P&O Cruises World Cruising, Princess Cruises, Seabourn (collectively, “Brands”) in each instance. Carnival Australia grants you a limited licence only, without any transfer of ownership rights, to use these Materials subject to the following conditions:
i) you may use the Materials for editorial purposes only. You must not use, and Carnival Australia does not licence the use of any images for the purposes of commercial activity such as, but not limited to, paid advertising, brochures or television commercials;
ii) you may not alter the Materials in any way;
iii) you may not use the Materials in any manner that implies that Carnival Australia or any of the Brands has sponsored or endorsed you or your business, product or activities;
iii) you may not use the Materials in any manner which Carnival Australia, in its sole discretion, determines defames, misrepresents or disparages Carnival Australia, the Brands, or any of their services and products;
iv) you may not use the Materials in connection with the products or services of a competitor of Carnival Australia and the Brands;
v) any use of the Materials by you must be in accordance with all applicable national, foreign or local laws, statutes, rules and regulations;
vi) use of the Materials must include a photographic credit for the photographer (if supplied) and the Brand specific to the Material.
To the fullest extent permitted by applicable law, these Materials are provided "AS IS", without warranties of any kind, express or implied, including, but not limited to, warranties of merchantability or fitness for a particular purpose. Under no circumstances shall Carnival Australia or the Brands be liable for any use by you of the Materials or any error, failure, defect or delay in your ability to access or use the Materials, including, but not limited to, any incidental, special, indirect or consequential damages resulting from same, even if Carnival Australia has been informed of the possibility of such damages arising. Under no circumstances shall Carnival Australia’s liability to you for use of the Materials exceed the amounts, if any, you paid to access this website. Carnival Australia reserves the right to change these Terms of Use at any time effective upon the posting of same on this website. You are therefore required to read and accept these Terms of Use each time you access the Materials from this website.
